The Service is provided "AS IS" and "AS AVAILABLE", with all faults and defects without warranty of any kind.

5. SMS Text Messaging Consent

5.1 Program Description: Holistic Vista operates an SMS text messaging program to send health tips, wellness insights, and account-related communications to subscribers who have provided prior express written consent.

5.2 TCPA Consent: By providing your mobile phone number and checking the consent checkbox, you provide prior express written consent under the TCPA, 47 U.S.C. § 227, to receive autodialed or pre-recorded text messages from Holistic Vista.

5.3 Consent Not Required: Your consent to receive SMS messages is not a condition of purchasing any product.

5.4 Message Frequency: Up to 30 messages per month for marketing. Transactional messages depend on account activity.

5.5 Message and Data Rates: Standard message and data rates may apply.

5.6 Opt-Out: You may opt out at any time by replying STOP to any message, or by emailing contact@holistic-vista.com. All opt-out requests will be honored within 10 business days.

5.7 Third-Party Sharing: Mobile information will not be shared with third parties for marketing purposes.

6. Governing Law

These Terms shall be governed by the laws of the United States. Before initiating any legal proceeding, contact Holistic Vista at contact@holistic-vista.com and attempt informal resolution for at least 30 calendar days.
